Terms of service.

1. Booking and Payment Terms

1.1 Booking Confirmation
A booking is confirmed only when the client has signed the contract and provided any required deposit as agreed. A written confirmation will be provided to the client.

1.2 Payment Terms
The client is responsible for all payments related to the cash bar service, including but not limited to setup fees, bartender fees, and any minimum spend requirements. The payment schedule will be outlined in the client's invoice.

1.3 Deposit
A non-refundable deposit may be required to secure the booking. This deposit will be credited toward the final payment dependant on the type of booking,

1.4 Booking Fee
A booking fee will be required to secure the booking. This will not be refunadable.

1.5 Cancellation Policy:
If the client cancels the event:

  • More than 30 days before the event: The deposit is non-refundable, but no further payment is required. If the booking form has been signed, the booking fee will not be returned.

  • Less than 14 days before the event: The client may be liable for the full amount of the minimum spend.

1.6 Consumer Rights
These Terms and Conditions do not affect the client's statutory rights under UK consumer law.

2. Minimum Spend Requirement

2.1 Minimum Spend
A minimum spend will be required for the cash bar service. The specific amount will be detailed in the client's invoice.

2.2 Shortfall
If the total spend on the day of the event is less than the minimum spend, the client will not receive a refund for the difference. The remaining amount will be retained by the bar company to meet the minimum spend requirement.

2.3 Exceeding the Minimum Spend
If the total spend exceeds the minimum spend, the client will not be required to pay any additional charges beyond what was spent by guests.

3. Bar Operations

3.1 Bar Setup:
The bar will be set up and ready to serve guests at the agreed-upon time. The client must ensure that the venue is available for setup at least 2 hours prior to the event start time.

3.2 Bar Closure
The bar will close at the agreed-upon time. If the event runs longer than scheduled, additional charges may apply.

3.3 Bartender Services
Proffessional bartenders will be provided as part of the service. Bartenders have the legal obligation to refuse service to any guests who are underage, visibly intoxicated, or acting inappropriately, in accordance with UK licensing laws.

3.4 Stock and Pricing
The cash bar will offer a selection of beverages as agreed during the booking process. Prices will be displayed at the bar, and guests are responsible for paying for their drinks. All pricing will include VAT.

3.5 Glassware and Equipment:
The bar company will provide all necessary glassware and equipment. The client is responsible for any damage to bar equipment or glassware caused by guests.

4. Licensing and Compliance

4.1 Licensing
The bar company will ensure that all necessary Temporary Event Notices (TENs) and other permits required under the Licensing Act 2003 are obtained for the event. The client is responsible for providing any information required to secure these permits.

4.2 Legal Drinking Age
Guests must be 18 years of age or older to purchase or consume alcohol. The bar company reserves the right to request identification from any guest and to refuse service if legal age cannot be verified.

4.3 Venue Rules
The client must ensure that the venue permits the sale and consumption of alcohol. The bar company will adhere to all venue rules and regulations concerning alcohol service. The venue reserves the right to halt service at any time. In such an event, no refund will be provided to the client.

4.4 Challenge 25 Policy
In compliance with UK law, the bar company will operate a "Challenge 25" policy, requiring anyone who looks under the age of 25 to provide acceptable ID before purchasing alcohol. Acceptable forms of ID include a passport, a UK driving licence, or a Proof of Age Standards Scheme (PASS) card.

4.5 Bar Manager

A Bar Manager will be onsite to oversee the entire event from set-up to derig. The Bar Manager will always hold a personal license and ensure that all aspects of the bar operation are conducted in compliance with legal regulations and event requirements.

5. Liability and Insurance

5.1 Liability
The bar company is not responsible for any injuries, damages, or losses that occur during the event, except where caused by the company's negligence. The client assumes full responsibility for the conduct of their guests.

5.2 Insurance
The bar company maintains public liability insurance as required under UK law. However, the client may be required to obtain additional insurance for certain types of events or venues. To request a copy of the public liability certificate, please contact a member of the Opal team.

6. Force Majeure

6.1 Unforeseen Circumstances
The bar company is not liable for any failure to perform its obligations under this agreement due to events beyond its reasonable control, such as natural disasters, pandemics, government restrictions, or other "force majeure" events.

7. Governing Law

7.1 Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Acceptance of Terms

By booking the cash bar service, the client agrees to these Terms and Conditions. Any amendments to these terms must be agreed upon in writing by both parties.
